Terms of Service

These Terms of Service are an agreement between you and New Big Inc, doing business as New Big Systems ("New Big Systems," "we," "us"), for the software at https://newbigsystems.com/ and https://app.newbigsystems.com/.

This page is our Terms of Service. It includes our Refund Policy, Cancellation Policy, Delivery and Returns terms, and the messaging rules and legal restrictions that apply to the service. Our Privacy Policy is a separate page.
The service and the price
New Big Systems is software that helps a business follow up with leads and book appointments. The software includes:
- SMS text messages
- Website live chat
- Phone calls and voicemail
- Appointment calendars
- Campaigns, funnels, and a sales pipeline
- A mobile app
- Connections to other tools, including through Zapier
The published plan is the Professional Plan. The Professional Plan costs 497 USD per month, billed in United States dollars (USD). It renews automatically each month until you cancel. By purchasing, you agree to that renewal.
Included amounts, provided again each month, are:
- 1 local phone number
- 3,000 emails
- 2,000 text messages
- 2,000 voice minutes
- Unlimited contacts, calendars, chats, funnels, triggers, and campaigns
- 7 or more automation templates
- Review management, an AI booking bot, and 5 sub-users per account
Usage above those amounts is billed in United States dollars (USD):
- Text message: 0.015 USD each
- Email: 0.004 USD each
- Local voicemail: 0.05 USD each
- Toll-free number: 5.00 USD each
- Toll-free minute: 0.08 USD each
- Toll-free voicemail: 0.08 USD each
- Extra local number: 1.00 USD each
- Local minute: 0.026 USD each
The same prices are shown at https://newbigsystems.com/. The service is offered to customers in the United States. New Big Systems is offering no free trial, discount, or promotional price. If a promotion is offered later, its full terms will be shown beside the offer before you accept them, including the date the promotional price ends and the regular price of 497 USD per month after that date.
Delivery and Returns
New Big Inc delivers the New Big Systems software. The Professional Plan provides access to SMS text messages, email, website live chat, phone calls, voicemail, appointment calendars, campaigns, and the mobile app. The price is 497 USD per month, in United States dollars (USD).
The shipping charge is 0 USD. There is no carrier, no shipping destination, and no package. There is no physical item to box up or ship back.
After your payment succeeds, we email login details to the email address you used to sign up. That email is sent within 30 minutes. You sign in at https://app.newbigsystems.com/. If the login email has not arrived within 30 minutes, email KellyB@newbigsystems.com or call 817-663-1600 and we will resend it.
The return process for the subscription fee is the Refund Policy below. To start it, email KellyB@newbigsystems.com from the email address on the account, or call 817-663-1600. Include the company name, the charge date, and the amount in USD.
Cancellation Policy
You can cancel the New Big Systems Professional Plan at any time. There is no long-term contract.
The Professional Plan costs 497 USD per month, in United States dollars (USD). It renews automatically each month until you cancel. Usage above the included amounts is billed in USD at the rates in these Terms.
Cancel by any one of these methods:
- Email KellyB@newbigsystems.com from the email address on the account. Write "Cancel" and include the company name.
- Call 817-663-1600.
- Sign in at https://app.newbigsystems.com/, then open Settings, then Billing, then Cancel.
A cancellation is effective when we receive it. We email a confirmation to the account email address. You keep access through the end of the month already paid. The next renewal is not charged. Usage that already occurred, and phone numbers already assigned, remain due at the published USD rates.
A refund of a subscription fee follows the Refund Policy on this page.
Refund Policy
This section states when a customer can receive a refund. All amounts are in United States dollars (USD).
The Professional Plan is 497 USD per month. If you email KellyB@newbigsystems.com within 30 days after your first successful Professional Plan payment, we will refund that subscription charge to the original payment method. This first-purchase subscription refund is available once per customer.
Text messages, emails, voicemail, phone minutes, and phone numbers already used or already assigned during that window stay charged at these USD rates:
- Text message: 0.015 USD each
- Email: 0.004 USD each
- Local voicemail: 0.05 USD each
- Toll-free number: 5.00 USD each
- Toll-free minute: 0.08 USD each
- Toll-free voicemail: 0.08 USD each
- Extra local number: 1.00 USD each
- Local minute: 0.026 USD each
After 30 days from the first payment, a subscription fee that has already been charged stays charged. Canceling stops the next renewal. Access continues through the end of the month already paid.
To request a refund, email KellyB@newbigsystems.com from the email address on the account, or call 817-663-1600. Include the company name, the date of the charge, and the amount in USD. We reply within 2 business days. An approved refund is submitted within 10 business days. The card issuer then posts the credit on its own schedule. Refunds are paid in United States dollars (USD) to the original payment method.
Payments and card security
Payments are processed by Stripe, a PCI-compliant payment processor. Card data is entered on a page protected by HTTPS. We do not store your full credit card number or security code on our servers. We accept Visa, Mastercard, American Express, and Discover. Prices and charges are in United States dollars (USD).
Your account
You must be at least 18 years old. You must provide a current name, company name, email address, and phone number, and keep them accurate. You are responsible for activity under your login.
Messaging rules and legal restrictions
Customers use New Big Systems to send SMS text messages, email, and phone calls. Those activities are regulated.
You must be at least 18 years old. The service is offered to customers in the United States. You may not buy or use the service for the benefit of a country, organization, entity, or person embargoed or blocked by the United States, including persons on sanctions lists maintained by the Office of Foreign Assets Control (OFAC).
You may text or call a person through the service only when you have that person's permission, as required by the Telephone Consumer Protection Act (TCPA), carrier rules, and any similar law that applies to you. You are responsible for keeping records of that permission.
Marketing text messages you send through the service must tell the recipient how to opt out. You must honor a request to stop. Replying STOP to a text message is a valid opt-out. After an opt-out, you must stop marketing texts and marketing calls to that person.
Marketing email you send through the service must identify you, include your mailing address, and include a working unsubscribe link, as required by the CAN-SPAM Act.
You may not use the service for unlawful content, deception, harassment, or emergency communications. You may not contact people who have opted out.
Customer data and our software
You keep ownership of the lead data and content you upload. You give us permission to host and transmit that data so we can provide the service. We own the software, the site, and our name and logo.
Our Privacy Policy explains what personal information we collect and how we use it. It is part of these Terms.
Service availability
We provide the software as available. We may change features. If we change the Professional Plan price, the new price applies to the next renewal, and we will post the new price on https://newbigsystems.com/ before that renewal.
Liability
To the extent the law allows, our total liability arising out of the service in any 12 month period is limited to the fees you paid to us for the service during the 3 months before the claim. We are not liable for indirect or consequential damages, including lost profits or lost data. Some states do not allow certain limits, and those limits apply only as far as the law allows.
Changes to these Terms
We may update these Terms by posting a new version on this page and changing the "Last updated" date. Continued use after the new date is acceptance of the updated Terms. The Refund Policy and Cancellation Policy on this page at the time of a purchase apply to that purchase.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
